HB25-1202 Increasing Public Awareness of Mold Health Effects

Summary: This bill sets new disclosure requirements around the mold history, or potential mold history, of a property during the sale or lease process. This bill would stigmatize properties with any history of mold, even after it has been properly mitigated, as there is no cutoff or lookback period for this disclosure requirement. Additionally, this bill adds a disclosure and brochure requirement during sale and lease of a property. 

CHC Position/Concerns:AMEND-The CHC seeks to amend this bill, as we do not feel the public is properly served by stigmatizing a property due to a mold event. If the mold was properly treated, mitigated, or remediated, and the underlying cause of the mold was also corrected, then there is minimal risk of new health issues for future residents.
