SB25-020 Tenant and Landlord Law Enforcement

Summary: This bill expands the Attorney General's authority to enforce landlord-tenant law, and grants counties, cities, and municipalities the power to bring civil and criminal actions to enforce certain state landlord-tenant laws. This bill also establishes a receivership mechanism for multifamily residential properties as a remedy for violations of certain laws.

CHC Position/Concerns:AMEND-The CHC seeks to amend this bill, as we do not feel that landlord-tenant law is a local issue. We believe it should be enforced uniformly across the state by a state authority. The Attorney General's office is already positioned to enforce landlord-tenant law, especially after the creation of the Housing Division in the recent past. Allowing local governments and municipalities to enforce certain aspects of landlord-tenant law means these laws will not be enforced uniformly, with one city enforcing rules in a different way than another city. This is good for neither the tenant nor the property owner, and opens a landlord up to increased liability if they must follow the same law in two different manners between cities or counties.
