Summary: This bill changes rent demands from 10-day demands to 30-day demands, regardless of tenant or property status, prohibits landlords from charging subsidy tenants a late fee that exceeds $20, and removes the current exemption from Source of Incom requirements for landlords with 5 or fewer units, which would require all landlords to accept housing choice vouchers.
CHC Position/Concerns:AMEND - The CHC is seeks to amend this bill, specifically the late fee clause, and the 30-day demand timeline. Tenants receiving housing subsidies already cannot be charged late fees for a housing authority's portion of the rent, and capping late fees in an amount separate from late fees for non-subsidy tenants mandates that we treat subsidy tenants differently from non-subsidy tenants. Additionally, we do not feel that Colorado tenants benefit from additional time with a demand letter before before moving forward with an eviction, especially as many rental assistance programs will not provide or approve a tenant with rental assistance unless there is an active court case.
