Summary: This bill codifies the right to jury trial in any action for possession of a rental property, and creates corresponding rules within the court system. This bill also removes the current allowance for leases to have a waiver of the right for a jury trial in cases of possession.
CHC Position/Concerns:OPPOSED-The Colorado Housing Coalition opposes this bill due to the burden in a jury trial in cases of possession would place on property owners and managers, to say nothing of the fees that residents may face if they request a jury trial and lose. This bill will expand the eviction timeline, already quite long, and place our county courts under additional strains to provide juries, courtrooms, and judges to preside over any jury trial.
